    Compliance

Cold email is legal in Australia, the UK and the US — on different terms in each

Outbound that ignores the rules gets your domain filtered and your business reported. This is how we run it in each market we serve, with the source for every rule.

What the law says, and what we do about it

    Spam Act 2003

Is B2B cold email legal in Australia?

Commercial email needs consent, even business to business. Consent can be inferred from an address that is conspicuously published, but only when the message relates to the recipient's role and the publication carries no "no unsolicited email" statement.

    What we do

    • Australian lists only use conspicuously published business addresses
    • Every prospect is filtered for role relevance before the first email
    • Addresses published with a no-marketing statement are excluded
    • Sender identified and a working unsubscribe in every email; opt-outs actioned well inside the 5 working days the Act allows

    PECR and UK GDPR

Is B2B cold email legal in the UK?

Companies and LLPs can be emailed without prior consent if the sender is identified and an opt-out is offered. Sole traders and some partnerships are treated like individuals and need consent. Named contacts are personal data, so a legitimate-interests assessment applies and an objection is absolute.

    What we do

    • Sole traders and partnerships are excluded from UK lists
    • A legitimate-interests assessment is recorded per campaign
    • Objections go onto a permanent suppression list, never re-imported
    • Sender identified and a working opt-out in every email

    CAN-SPAM Act

Is B2B cold email legal in the United States?

There is no business-to-business exemption. Headers and subject lines must be honest, the email must carry a valid physical postal address, and opt-outs must work and be honoured.

    What we do

    • Accurate sender names and subject lines that match the content
    • Your business's postal address in every sequence
    • One-click unsubscribe, honoured within 2 business days

    Every market

What Gmail, Yahoo and Outlook require of senders

The law decides whether you may send. Mailbox providers decide whether it arrives. Their rules apply everywhere, and they are stricter in practice than most anti-spam law.

    Authenticated domains

SPF, DKIM and DMARC on every sending domain. Gmail requires them, and Outlook.com sends unauthenticated bulk mail to junk.

    Secondary domains

Outbound never runs from your main domain, so your day-to-day email is not put at risk by a campaign.

    Warmup and volume caps

New inboxes are warmed before use and each inbox has a daily cap, so volume is spread rather than spiked.

    Spam rate under 0.1%

Gmail and Yahoo filter senders above 0.3%. We monitor daily and pause at a third of that.

    One-click unsubscribe

A working unsubscribe in every email, processed within 2 business days.

    LinkedIn is assisted, never automated

LinkedIn's User Agreement prohibits bots and automation tools, and the account that gets restricted is yours. So we research the prospects and draft the messages, and you (or someone on your team) send them. It is slower than a bot and it does not put your profile at risk.

    Straight answers

Is B2B cold email legal in Australia?

Yes, under conditions. Commercial email needs consent, even business to business. Consent can be inferred from an address that is conspicuously published, but only when the message relates to the recipient's role and the publication carries no "no unsolicited email" statement. We only email Australian prospects whose business address is published and whose role makes the message relevant.

Is B2B cold email legal in the UK?

Yes, to companies. Companies and LLPs can be emailed without prior consent if the sender is identified and an opt-out is offered. Sole traders and some partnerships are treated like individuals and need consent. Named contacts are personal data, so a legitimate-interests assessment applies and an objection is absolute. We exclude sole traders and partnerships from UK lists and keep a permanent suppression list.

Is B2B cold email legal in the United States?

Yes. There is no business-to-business exemption. Headers and subject lines must be honest, the email must carry a valid physical postal address, and opt-outs must work and be honoured.

Why don't you automate LinkedIn outreach?

LinkedIn's User Agreement prohibits bots and automation tools, and the account that gets restricted is yours. So we research the prospects and draft the messages, and you (or someone on your team) send them. It is slower than a bot and it does not put your profile at risk.

This describes how we run outbound. It is not legal advice, and you remain responsible for the offer and claims in your own campaigns. If your industry is regulated, check with your adviser before launch.

Compliance is built into every plan

Sending infrastructure, list filtering and opt-out handling are part of the setup, not an upgrade.
